  1. Personal Data We Collect or Process

    1. The Services capture some information about you automatically utilizing background local storage and session storage technologies (“Cookies”). Cookies are small files or other pieces of data which are downloaded or stored on your computer or another device, that can be tied to information about your use of the Services (including certain third-party services and features offered as part of our website). Examples of information of this type are your IP address, the browser you are using, information about your network and device, the operating system you are using, the Internet pages you visited prior to coming to our website, the pages on the website that you visit and details of your browsing activity on our website (such as your clicks, internal pages visited, searches and timestamps) and transaction activity, such as the amount, date and time for each transaction. When we use Cookies, we may use “session” cookies that last until you close your browser or “persistent” cookies that last until you or your browser delete them.     2. We operate social media pages on third-party networks and have social media icons on our website. When you visit or link to our social media pages, data is processed both by us and the applicable social media provider. Social media providers are unaffiliated with us, and we are not responsible for the content or privacy practices of social media providers.       • Register as a member of our loyalty and rewards program

      • Purchase an e-gift card
      • Submit an application for employment with Sweet Paris or any of our franchisees
      • Inquire about franchise opportunities

      You will be asked for your name, email, and phone number, and for online food or e-gift card orders; your payment card information, billing, and shipping addresses. For e-gift orders, we will also collect the information about the card recipient. Optionally, you may provide your birth month and day should you wish to receive a birthday treat from us.

      If you inquire about a franchise opportunity, we ask for information to help us evaluate your application, including your occupation, franchise experience, restaurant experience, area of interest, the amount for investment capital, and approximate net worth.

    4. Our online ordering and payment processing systems are supported by third-party providers who will allow you to create an account with a username and password. Please see Section 3 below for more information.

    5. We do not knowingly collect information from users of our Site under the age of 18 and/or their internet usage, and such persons are not authorized to use the Services. If we obtain actual knowledge that a user is under 18, we will take steps to remove that user's personal information from our databases. By using the Services, you represent that you are at least 18 years old. You also represent, by accessing or using the Services, that you are of legal age to enter into legal agreements, or if you are not, that you have obtained your parent’s or legal guardian’s consent to accept the terms in this Privacy Policy.

    We use the personal data we collect to respond to your inquiries, fulfill your orders, administer our loyalty and rewards program, provide or enhance our Services, perform our contractual obligations, provide updates and other important information related to your activity on and with the Services, communicate with you on your birthday (with your consent), inform you of new services or changes in Services, administer the Services, fill employment positions, enter into contracts for services, to fulfill legal obligations we have to governmental authorities or other third parties, and for other legitimate business purposes. You will have the opportunity to opt-out of any electronic marketing communications you may receive from us.

    Please note that if you provide a mobile phone number, you are consenting to receive text messages from us and/or our ordering and payment processors about your orders. We also communicate via text messaging to our rewards program members. We typically send one text message a month. Our communications may, for example, inform you of a special deal, invite you to complete a survey, or invite you to participate in special giveaways or activities. You will have the opportunity to opt-out of any text messaging communications you may receive from us.

  3. With Whom We Share Personal Data

    In order to provide the Services, Sweet Paris shares your personal data to third parties who perform services on our behalf, or the website enables third party providers to collect personal data directly from you on our behalf, including without limitation our technology providers, analytics providers, electronic communication providers and professional advisors. Sweet Paris’ relationship with such third parties is contractual in nature, as each such third party is a third-party vendor to Sweet Paris, and they are not subject to Sweet Paris’ direction or control; thus, the relationships are not, and should not be construed as, one of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers or the like.

    We utilize the services of Toast, our point-of sale provider, for our online food orders and loyalty and rewards program registration. When you place an online order or register for our loyalty and rewards program, you are consenting to use the services of Toast. Toast has its own privacy policy and terms of use that you should review prior to completing an online order. Toast may, in turn, have their own service providers that process your personal data on Toast’s behalf.

    We utilize the services of Securetree App, to administer our gift card system. Please see the privacy disclosures and terms set forth on https://sweetparis.securetree.com/terms-and-privacy/.

    We may disclose information if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others’ interests or property, or to enforce agreements you enter into with us.

    We may share your data with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.

    We may share aggregated and de-identified information with third parties for analytical, research or other similar purposes.

    We may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Services, including for any other contemplated uses of your personal data not addressed in this Privacy Policy. Please read all online agreements carefully before accepting them.

  4. Storage and Protection of Your Personal Data

    We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations. Notwithstanding the generality of the foregoing, we store email addresses and phone numbers until the user requests their information to be removed from our systems.

    Sweet Paris does not collect or store payment card information; rather we utilize the Toast platform and payment processors and store only an electronic receipt that sets forth confirming payment details, such as purchase date, the expiration date of the payment card and the payment ID, but not complete payment card information. If you create a Toast account, you have the option to have Toast store and remember your payment card information for future purchases. You may update your card information or cancel this authorization to Toast any time via the “My Account” page of the Toast Online Ordering website.

    We take reasonable administrative, physical and technical precautions to protect your personal data and communications between us. This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your data that they will protect the data with reasonable safeguards that are substantially equivalent to those used by us.

    No Internet or e-mail transmission is ever fully secure or error free, however. We therefore cannot guarantee absolute security of your data, and we are not responsible for processes and networks that we do not control. Users assume the risk of security breaches and the consequences resulting from them. Please be careful in deciding what information you send to us via email or over the Internet.

Some non-marketing communications may not be subject to general opt-outs, such as communications about transactions, disclosures to comply with legal requirements, and support-related information.

    Subject to local law, you may have additional rights under the laws of your jurisdiction regarding your personal data, such as the right to complain to your local data protection authority.

    You may be able to disable cookies through your browser settings, but if you delete or disable cookies, you may experience interruptions or limited functionality in certain areas of the Services.

    California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed.
